Please note: If you send a post dated check in to ,say your mortgage company!! They will send it on to the bank, If it is early..... I WILL be learning this today and will answer here again.
Post Dated checks are perfectly legal as long as the person who receives the check does not cash it before its due date. None of this is answering the question as to what is the law!!
However, many banks do cash checks presented before the due date, and may not be held liable unless certain steps have been followed to prevent them from doing so.
Commercial organizations often state on their invoices that they do not accept PD checks and all checks will be deposited immediately.
Some states, including California and Georgia, place responsibility on check writers to ensure their checks are not cashed or deposited too quickly.
Other states, like West Virginia, place responsibility on the person the check is written to.This is an exclusion clause to protect them from legal action.
